1. Overview
Welcome to 73 Fly, New Zealand’s trusted travel eSIM provider (“we”, “us”, “our”). These Terms of Service (“Terms”) explain your rights and responsibilities when you buy or use our eSIM products and related services (the “Services”). By visiting our website or purchasing an eSIM, you agree to these Terms and our Privacy Policy.
2. Eligibility & Account
- You must be at least 18 years old (or the age of majority in your country) to use our Services.
- You agree that information you provide (email, payment details, device info) is true, current, and complete.
- You’re responsible for keeping your account secure and for all activity under it.
3. Our Products
- 73 Fly sells digital eSIM data plans for travel. Unless stated otherwise, plans are data-only. Use WhatsApp, FaceTime, or Messenger for calls and messages.
- Coverage, speed, and availability depend on local networks in the country or region you select.
- We aim for accurate product information, but performance may vary. We may change or discontinue products, prices, or promotions at any time without notice.
4. Orders & Payment
- Placing an order is an offer to purchase. An order is accepted once payment is successfully processed.
- Prices are shown in NZD and include GST unless stated otherwise.
- We may cancel or refuse orders if payment cannot be verified or for suspected misuse.
- eSIMs are delivered digitally via email and can usually be installed immediately. Please check your device is eSIM-compatible before purchase.
- Refunds are only available as set out in our Refund Policy.
5. Using Your eSIM
- Use is for lawful personal travel only. Resale, transfer, or modification of the eSIM profile is prohibited.
- Your plan starts when first activated/connected at your destination and runs for the purchased period or data amount.
- To avoid roaming charges from your NZ mobile provider, turn off roaming or mobile data on your physical SIM. We’re not responsible for charges from your existing provider.
6. Intellectual Property
All content on our website and Services (logos, text, images, design) is owned by 73 Fly or its licensors and protected by law. You may not copy or use our materials for commercial purposes without written permission.
7. Third-Party Networks & Links
Our eSIMs connect via overseas partner networks we do not control; outages, restrictions, or coverage issues may occur. Our site may link to third-party websites; we aren’t responsible for their content or policies.
8. Disclaimer of Warranties
We aim to provide reliable connectivity but do not guarantee uninterrupted service, specific speeds, or coverage. The Services are provided “as is” and “as available” except where required by New Zealand law.
9. Limitation of Liability
To the maximum extent permitted by law, 73 Fly is not liable for indirect, consequential, or incidental loss (including loss of profits or data) arising from use or inability to use the Services. Our total liability will not exceed the amount you paid for the relevant eSIM.
10. Indemnity
You agree to indemnify and hold harmless 73 Fly and its personnel from claims, losses, or damages arising from your misuse of the Services or breach of these Terms.
11. Termination
We may suspend or cancel your access to the Services if you breach these Terms. Sections on intellectual property, liability, indemnity, and governing law continue after termination.
12. Governing Law & Jurisdiction
These Terms and any disputes are governed by the laws of New Zealand. You agree to the exclusive jurisdiction of the courts of New Zealand.
13. Changes to These Terms
We may update these Terms from time to time by posting a new version on this page. Your continued use of the Services after updates means you accept the revised Terms.
